General Terms and Conditions
Valid from 01.01.2024
Subject of the contract
Cruise Expert GmbH arranges cruises and related services in the name and on behalf of the customer. The contract for the travel service is concluded between the customer and the respective service provider (e.g. cruise line).
Conclusion of contract
By making a booking, the customer bindingly instructs Cruise Expert to arrange a travel service. The booking can be made in writing, by telephone or online. The contract is concluded as soon as the booking is confirmed by the respective provider.
Services of Cruise Expert
Cruise Expert acts as an intermediary and is not liable for the performance of the travel services arranged. The respective provider is solely responsible for the scope and quality of the travel services.
Prices and payment terms
Prices are based on the details provided by the service providers at the time of booking. Payments are made in accordance with the payment terms of the respective provider. Cruise Expert may require deposits or full payment in advance.
Cancellation and rebooking
Cancellations or rebookings are subject to the conditions of the respective provider. In addition, Cruise Expert may charge a processing fee.
Liability
Cruise Expert is only liable for errors in the arrangement. There is no liability for the proper execution of the trip. No liability in the event of force majeure, strikes, natural disasters or similar events.
Data protection
Personal data is used exclusively for processing the booking. It will only be passed on to third parties if this is necessary for the performance of the contract or is required by law.
Applicable law and place of jurisdiction
Swiss law applies. The place of jurisdiction is Altenrhein, insofar as legally permissible.
Final provisions
Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected. Amendments and additions must be made in writing.
Note on package travel
If the service offered constitutes a package tour within the meaning of the Federal Act on Package Travel (PRG), the provisions of the PRG shall also apply. The customer will be informed of all legally required information (e.g. rights, withdrawal, insolvency protection) before concluding the contract.
Right of withdrawal
There is no statutory right of withdrawal when booking travel services. Cancellations are subject exclusively to the conditions of the respective provider.
